MARCOS AN ACT CONVERTING THE CAVITE CAMPUS OF THE EULOGIO "AMANG" RODRIGUEZ INSTITUTE OF SCIENCE AND TECHNOLOGY IN THE MUNICIPALITY OF GENERAL MARIANO ALVAREZ, PROVINCE OF CAVITE INTO A REGULAR CAMPUS AND APPROPRIATING FUNDS THEREFOR EXPLANATORY NOTE Expanding and strengthening state universities and colleges is essential to achieving inclusive growth and regional development. The State is mandated to prioritize education under Article II, Section 17 of the 1987 Constitution ensuring that quality education is a right, not a luxury only a few can afford. The Eulogio "Amang" Rodriguez Institute of Science and Technology (EARIST) has long been recognized for its contribution to technical, vocational, and science and technology education. The EARIST-Cavite Campus, located in the Municipality of General Mariano Alvarez, serves as the only state college in the locality and caters to students not only from General Mariano Alvarez but also from neighboring municipalities in Cavite and the Calabarzon Region. Despite its growing student population and demonstrated capability, the campus currently operates as a satellite unit dependent on the budgetary allocation of its main campus in Manila. Converting the EARIST-Cavite Campus into a regular campus will ensure a stable and direct funding allocation under the national budget, enabling it to expand academic programs, upgrade facilities, strengthen research and extension services, and better respond to the human resource development needs of the province and the region. Institutionalizing its status will also enhance the administrative efficiency and long-term planning capacity.
This measure affirms the State's commitment to broadening access to quality, affordable higher education and to supporting the continued development of Cavite as a key growth area in Calabarzon. MARCOS AN ACT CONVERTING THE CAVITE CAMPUS OF THE EULOGIO "AMANG" RODRIGUEZ INSTITUTE OF SCIENCE AND TECHNOLOGY IN THE MUNICIPALITY OF GENERAL MARIANO ALVAREZ, PROVINCE OF CAVITE INTO A REGULAR CAMPUS AND APPROPRIATING FUNDS THEREFOR Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Short Title. - This Act shall be known as the "Eulogio 'Amang'
Rodriguez Institute of Science and Technology (EARIST)- Cavite Campus Act".
SEC. 2. Conversion into a Regular Campus. - The EARIST-Cavite Campus
located in the Municipality of General Mariano Alvarez, Province of Cavite, is converted into a regular campus of the EARIST to be known as the "EARIST-Cavite Campus".
SEC. 3. General Mandate. - The EARIST-Cavite Campus shall offer short-term,
technical-vocational, undergraduate, and graduate courses within its areas of competency and specialization pursuant to mandate of the EARIST, and according to its capability as the Board of Regents, hereinafter referred to as the Board, may deem necessary for the accomplishment of its objectives, and those which respond to the human resource development needs of the Province of Cavite and CALABARAZON Region. The EARIST-Cavite Campus is also mandated to undertake research and extension services in support of the socio-economic development and to provide progressive leadership in these areas.
SEC. 4. Supervision and Management. - The EARSIT-Cavite Campus shall be
headed by a Campus Director, to be appointed by the Board subject to its guidelines,
qualifications, and standards, and upon the recommendation of a Search Committee duly constituted for the purpose of selecting the Campus Director.
SEC. 5. Compliance with the Requirements of the Commission on Higher
Education (CHED). - The EARIST shall ensure the compliance od the EARIST-Cavite Campus with the policies, standards, and guidelines of the CHED for the operation of a regular campus, including those related to the offering of courses and the introduction of new or revised programs prior to its conversion as a regular campus.
SEC. 6. Management of Personnel, Assets and Records. - All assets, both real
and personal, personnel, and records of the EARIST-Cavite Campus, as well as its liabilities and obligations, shall be transferred to the EARIST. The positions, rights, and security of tenure of faculty members and personnel therein employed under existing laws prior to the conversion into a regular campus shall be respected. All parcels of land belonging to the government occupied by the EARIST-Cavite Campus shall be transferred to the EARIST: Provided, that should the campus or the EARIST cease to exist or be abolished or should such aforementioned parcels of land be no longer needed by the EARIST, the same shall revert to the local government unit concerned or to the Republic of the Philippines, as the case may be.
SEC. 7. Suppletory Application. - The provisions of Republic Act No. 8292,
otherwise known as the "Higher Education Modernization Act of 1997", shall form part this Act.
SEC. 8. Appropriations. - The amount necessary to carry out the provisions of
this Act shall be included in the annual General Appropriations Act.
SEC. 9. Separability Clause. - If for any reason, any part or provision of this Act
is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect.
SEC. 10. Repealing Clause. - All laws, decrees, executive orders, rules and
regulations or parts thereof inconsistent with or contrary to the provisions of this Act are deemed amended, repealed, or modified accordingly.
SEC. 11. Effectivity. - This Act shall take effect fifteen (15) days following
completion of its publication in the Official Gazette and in at least two (2) newspapers of general circulation. Approved,
