MARCOS AN ACT INCREASING THE COMPULSORY AGE OF RETIREMENT FOR OFFICERS AND NON-OFFICERS OF THE PHILIPPINE NATIONAL POLICE (PNP) FROM 56 YEARS OLD TO 57 YEARS OLD, AMENDING FOR THE PURPOSE SECTION 39 OF REPUBLIC ACT NO. 6975, OTHERWISE KNOWN AS THE "DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ACT OF 1990" EXPLANATORY NOTE At present, the mandatory retirement age of police officers is 56 years old. There are proposals to raise the police's age of compulsory retirement due to the following reasons: increased life expectancy rates based on various studies, extending the police officers' retirement age will ensure more experienced men at the helm of the Philippine National Police (PNP), and members of the police force aged 57 are still agile and physically fit to accomplish their duties, among others. Undersecretary for Police Affairs Isagani Nerez, in his speech before the Pangasinan Police Provincial Office last March 2024, also said that the "proposed increase by a year of the Philippine National Police (PNP) retirement age will allow law enforcers to further serve the public." This bill proposes to increase the compulsory retirement age of PNP officers and personnel from 56 to 57 years old, similar to the Armed Forces of the Philippines (AFP), to ensure continuity and stability in the leadership and excellence in the PNP. SECTION 39 OF REPUBLIC ACT NO. 6975, OTHERWISE KNOWN AS THE
"DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ACT OF Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Compulsory Retirement for Philippine National Police Personnel.
- Section 39 of Republic Act No. 6975, otherwise known as the "Department of the Interior and Local Government Act of 1990", is hereby amended to read as follows: "SECTION 39. Compulsory Retirement. - Compulsory retirement, for officer and non-officer, shall be upon the attainment of age [fifty six (56)] FIFTY-SEVEN (57): Provided, That, in case of any officer with the rank of chief superintendent, director or deputy director general, the Commission may allow his retention in the service for an unextendible period of one (1) year."
Sec. 2. Repealing Clause. - All other laws, decrees, orders, rules and
regulations, issuances or parts thereof inconsistent with the provisions of this Act are hereby repealed or modified accordingly.
Sec. 3. Effectivity. - This Act shall take effect after fifteen (15) days following
the completion of its publication either in the Official Gazette or in a newspaper of general circulation in the Philippines. Approved,
