No. 1040 Introduced by Senator Jinggoy Ejercito Estrada AN ACT INCREASING THE COMPULSORY AGE OF RETIREMENT FOR OFFICERS AND NON-OFFICERS OF THE PHILIPPINE NATIONAL POLICE FROM FIFTY-SIX (56) YEARS OLD TO FIFTY-SEVEN (57) YEARS OLD, AMENDING FOR THE PURPOSE SECTION 39 OF REPUBLIC ACT NO. 6975, OTHERWISE KNOWN AS THE "DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ACT OF 1990", AS AMENDED EXPLANATORY NOTE During the 19th Congress, this representation, as Chairperson of the Senate Committee on National Defense and Unity, Peace, Unification and Reconciliation, sponsored a Committee Report which, among others, adjusted the retirement age of the military personnel. The bill, which was later enacted into law as Republic Act No. 119391, aimed to strike a balance between proposals to increase the compulsory age of retirement (which for many years has been fixed at 56 years old), and the need to preserve opportunities for career progression in the armed forces and prevent bottlenecks in promotion brought about by sudden giant leap in retirement age from 56 to 59 for generals as provided under Republic Act No. 117092. Moreover, when compared to other jurisdictions, the retirement age of Filipino military personnel is one of the earliest in the region. 1 An Act Further Strengthening Professionalism and Promoting the Continuity of Policies and Modernization Initiatives in the Armed Forces of the Philippines, and Amending for this Purpose Republic Act No. 11709, signed into law on 17 May 2023 2 Section 6 (a) (2) of RA 11709
This proposal takes cue from the previous deliberations of the aforementioned law, taking into consideration the fact that 56 is indeed too young for our police men and women to retire, especially for higher-ranking officers who are equipped with experience and expertise they acquired through the years. This is also one way of maximizing the investment made by the government in providing education and trainings to our police officials, that would otherwise be taken advantage of by the private sector when they leave the service. At 56, one can still fulfil the demands and rigors of their position, and may still be considered at the prime of their life who are very much capable of rendering public service. This measure was reported out by the Senate Committee on Public Order and Dangerous Drugs during the 19h Congress. In view of harmonizing the retirement age for the military and police forces, and ensuring stability, efficiency and competence in the Philippine National Police (PNP) which is mandated to maintain peace and order and public safety, the immediate passage of this bill is hereby endorsed. Section 1. Section 39 of R.A. No. 6975, as amended by R.A. No. 11200, is
2 hereby further amended to read as follows: "SEC. 39. Compulsory Retirement. - Compulsory retirement, for officer and non-officer, shall be upon the attainment of age [fifty six (56)] FIFTY-SEVEN (57): Provided, That, in case of any officer with the rank of Police Brigadier General, Police Major General or Police Lieutenant General, the Commission may allow his retention in the service for an unextendible period of one (1) year[-1: PROVIDED, FURTHER, THAT UNIFORMED PERSONNEL WHO HAVE LESS THAN ONE (1) YEAR IN THE SERVICE UPON THE EFFECTIVITY OF THIS ACT SHALL HAVE THE OPTION TO RETIRE AT THE AGE OF FIFTY-SIX (56)."
Sec. 2. Repealing Clause. - All other laws, decrees, executive orders, and rules
2 and regulations contrary or inconsistent with the provisions of this Act are hereby 3 repealed or modified accordingly.
Sec. 3. Effectivity. - This Act shall take effect fifteen (15) days after its complete
