No. 878 Introduced by Senator Jinggoy Ejercito Estrada AN ACT PROMOTING OPERATIONAL EFFICIENCY THROUGH THE ESTABLISHMENT OF A RETAINED INCOME FUND FOR THE MOVIE AND TELEVISION REVIEW AND CLASSIFICATION BOARD (MTRCB), AMENDING FOR THE PURPOSE PRESIDENTIAL DECREE NO. 1986, OTHERWISE KNOWN AS "CREATING THE MOVIE AND TELEVISION REVIEW AND CLASSIFICATION BOARD" EXPLANATORY NOTE The Movie and Television Review and Classification Board (MTRCB) was established by virtue of Presidential Decree No. 1986 in October 1985. The Board operates in a dual capacity - functioning as a regulatory body which screens and examines motion pictures, television programs and publicity materials, and as a developmental agency which empowers families through campaign and information drives to make appropriate, intelligent choices regarding media and entertainment content. Through the years, the MTRCB has pursued the mission of protecting the Filipino child by creating parent-partners in the monitoring and responsible consumption of television shows and movies, and promoted respect for Filipino cultural values in carrying out its functions. The Board is one of the government agencies with steady revenue collections enough to shoulder its maintenance and other operating expenses (MOOE) and capital outlay (CO) needs. Only the expenditures for Personnel Services (PS) are funded through the annual General Appropriations Act. This measure seeks to do away with such inefficiency and in lieu thereof, introduces adequate safeguards to promote transparency and accountability in its utilization of public funds. Section 1. Section 20 of Presidential Decree No. 1986 is hereby amended to

read as follows: [Section 20. Sinking Fund. - Notwithstanding any provision of law, rule or regulation, executive or administrative order to the contrary, there is hereby established a Sinking Fund, to be administered at all times by the BOARD, consisting of all such fees and charges levied, assessed, and collected by the BOARD which shall be at immediate disposal of the BOARD to be used exclusively for the operationat and administrative expenses of the BOARD and for the acquisition of necessary facilities, supplies and equipment.] "SECTION 20. RETAINED INCOME FUND. - NOTWITHSTANDING ANY PROVISION OF LAW, RULE, REGULATION, EXECUTIVE OR ADMINISTRATIVE ORDER TO THE CONTRARY, THERE IS HEREBY ESTABLISHED A RETAINED INCOME FUND, TO BE MAINTAINED AND ADMINISTERED AT ALL

TIMES BY THE BOARD, WITHOUT NEED FOR REMITTANCE TO THE NATIONAL TREASURY, BUT SUBJECT TO EXISTING GOVERNMENT AUDITING RULES AND REGULATIONS. IT SHALL COMPRISE FIFTY PERCENT (50%) OF ALL FEES, CHARGES, IMPOSITIONS, FINES, AND/OR PENALTIES IMPOSED, LEVIED, ASSESSED, AND COLLECTED BY THE BOARD. IT SHALL BE AT THE IMMEDIATE DISPOSAL OF THE BOARD TO BE USED FOR THE MAINTENANCE, OPERATIONAL AND ADMINISTRATIVE EXPENSES OF THE BOARD, AND THE ACQUISITION OF NECESSARY PROPERTIES, FACILITIES, SUPPLIES, AND EQUIPMENT: PROVIDED, THAT NO AMOUNT OF THE SAID FUND SHALL BE USED FOR THE PAYMENT OF SALARIES AND OTHER ALLOWANCES. THE BOARD SHALL SUBMIT, EITHER IN PRINTED FORM OR BY WAY OF ELECTRONIC DOCUMENT, TO THE DEPARTMENT OF BUDGET AND MANAGEMENT (DBM), WITH COPIES GIVEN TO THE HOUSE COMMITTEE ON APPROPRIATIONS AND THE SENATE COMMITTEE ON FINANCE, SEPARATE QUARTERLY REPORTS ON INCOME OF, AND EXPENDITURE FROM, THE FUND. ANY DISBURSEMENT IN THE SUBSEQUENT QUARTERS SHALL BE VOID, EXCEPT UPON CERTIFICATION BY THE DBM THAT SAID REPORT HAS BEEN SUBMITTED."

Sec. 2. Separability Clause. - If for any reason, any provision of this Act is

declared unconstitutional or invalid, such parts not affected thereby shall remain in full force and effect.

Sec. 3. Repealing Clause. - All laws, decrees, executive orders, rules and

regulations and other issuances or parts thereof which are contrary to or inconsistent with this Act are hereby repealed, amended or modified accordingly.

Sec. 4. Effectivity. - This Act shall take effect fifteen (15) days after its

publication in the Official Gazette or in any newspaper of general circulation. Approved,
