Marcoleta AN ACT PROMOTING THE ADOPTION OF SOLAR ENERGY OR ANY EQUIVALENT RENEWABLE ENERGY TECHNOLOGY IN ALL GOVERNMENT BUILDINGS AND OFFICES, PROVIDING FUNDS THEREFOR, AND FOR OTHER PURPOSES EXPLANATORY NOTE In an age where energy-resilience is not just a matter of economic growth but of state survival and development, it has become integral for the government to find ways to efficiently harness and utilize our energy sources, most especially our renewable energy resources. The heavy emphasis on renewable energy has long been enshrined in our country's legislative history through various landmark measures such as Republic Act No. 9513 or the Renewable Energy Act of 2008 and Republic Act No. 11285 (RA 11285) or the Energy Efficiency and Conservation Act. But a 2023 Resolution from the Inter- Agency Energy Efficiency and Conservation Committee (IAEECCa body created under RA 11285 to oversee energy cost reduction efforts in state buildings and facilities— has pushed the government to "walk the talk" by encouraging all agencies to install and utilize solar photovoltaic (PV) systems or any equivalent renewable energy technology in government facilities and office buildings. 1 This bill aims to institutionalize the laudable IAEECC Resolution by mandating all government agencies to install their own solar PV system or other equivalent renewable energy technology and to source a considerable portion of their power needs from these systems. It also requires the Department of Energy to readily advise and assist all government entities in the installation of renewable energy systems. By * IAEECC Resolution No. 8 (2023).

Marcoleta AN ACT PROMOTING THE ADOPTION OF SOLAR ENERGY OR ANY EQUIVALENT RENEWABLE ENERGY TECHNOLOGY IN ALL GOVERNMENT BUILDINGS AND OFFICES, PROVIDING FUNDS THEREFOR, AND FOR OTHER PURPOSES Be it enacted by the Senate and the House of Representatives of the Philippines in Congress assembled:

Section 1. Short Title. - This Act shall be known as the "Renewable Energy in

Sec. 2. Declaration of Policy. - The State recognizes energy security as a

necessary component of the country's inclusive, sustained, and broad-based growth. 5 The State further recognizes the need for the government to lead by example in institutionalizing energy efficiency and conservation as a national way of life. To this end, it is hereby declared the policy of the State to promote the use of solar technology or any equivalent renewable energy technology by requiring the utilization of renewable energy resources in government buildings and offices; to 10 establish the infrastructure and mechanisms necessary in ensuring an efficient, cost- effective, and sustainable power supply from renewable energy sources; and to ensure energy-sufficiency of government agencies for the prompt and unhampered delivery of services to its constituents.

Sec. 3. Establishment of Renewable Energy Systems in Government Buildings

and Offices. - All government agencies, in coordination with the Department of Energy (DOE), shall install a solar photovoltaic (PV) system or any equivalent renewable energy technology in their respective offices and buildings within three (3) years from the effectivity of this Act.

Sec. 4. Minimum Energy Supply. - The solar PV system or equivalent renewable

energy technology to be installed shall supply at least twenty percent (20% of the government agency's electricity requirement based on its highest monthly kilowatt- hour (kWh) billing demand of the previous year.

Sec. 5. Agency Assistance. - The DOE shall provide the official list of solar PV

installers or other equivalent renewable energy technology providers for reference and guidance of all government agencies. It shall likewise provide technical assistance in the installation of the solar PV system or equivalent renewable energy technology system. The DOE, in collaboration with the Department of Public Works and Highways, shall assist any government agency in evaluating the structural integrity of its office buildings and/or facilities for the installation of the said solar PV system or equivalent renewable energy technology.

Sec. 6. Appropriations. - The amount necessary for the implementation of this

Act shall be included in the annual General Appropriations Act.

Sec. 7. Implementing Rules and Regulations. - Within sixty (60) days after the

effectivity of this Act, the DOE shall, in coordination with the Inter-Agency Energy Efficiency and Conservation Committee created under Republic Act No. 11285 or the Energy Efficiency and Conservation Act, and in consultation with other relevant government agencies and stakeholders in the electric power and renewable energy industry, promulgate the rules and regulations to effectively implement the provisions of this Act.

Sec. 8: Separability Clause. - If any provision or part of this Act is declared

invalid or unconstitutional, the remainder thereof not otherwise affected shall remain in full force and effect.

Sec. 9. Repealing Clause. - All laws, presidential decrees, executive orders,

letters of instructions, proclamations or administrative regulations that are inconsistent with the provisions of this Act are hereby repealed, amended, or modified accordingly.

Sec. 10. Effectivity. - This Act shall take effect fifteen (15) days following its

publication in the Official Gazette or in a newspaper of general circulation. Approved,
