TWENTIETH CONGRESS OF THE JUL 10 P6:32 REPUBLIC OF THE PHILIPPINES First Regular Session SENATE RECENSO EY S. B. No. Introduced by Senator Rodante D. Marcoleta EXPANDING THE PURPOSE AND APPLICATION OF THE SPECTAL EDUCATION FUND, AMENDING FOR THE PURPOSE SECTION 272 OF REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991, AND FOR OTHER PURPOSES EXPLANATORY NOTE Article XIV, Section 1 of the 1987 Constitution mandates that "[t]he State shall protect and promote the right of all citizens to quality education at all levels and shall take appropriate steps to make such education accessible to all." Thus, there is a clear need to take vital steps to address the limitation set by the existing provisions of Republic Act No. 7160 or the Local Government Code (LGC) of 1991 on the utilization of the Special Education Fund (SEF).

Section 235 of LGC of 1991 states that "(a] province or city, or a municipality

within the Metropolitan Manila Area, may levy and collect an annual tax of one percent (1%) on the assessed value of real property which shall be in addition to the basic real property tax." It also declares that the proceeds of the same shall exclusively accrue to the SEF. According to existing law, the said expenses will be determined and approved by the local school board. In a report released by the Second Congressional Commission on Education (EDCOM 2), the SEF across the country remains underutilized, despite an increase in income'. Corollary, the Department of Education continues to be challenged with perennial issues on learning environments, learning outcomes, teacher welfare and * EDCOM2, "LGU Special Education Fund underutilized, inequitable - EDCOM 2", March 11, 2024, available at https://edcom2.gov.ph/lgu-special-education-fund-underutilized/ (last accessed on July 07, 2025).

resource gaps - areas that require substantive resources. Hence, the need for the expansion of the purpose and application of SEF in order to tap the capability of local government units (LGUs) in addressing these issues within their respective jurisdiction. This measure ensures that SEF is maximized, in response to our LGUs need for additional support to achieve the quality education for our youth. In view of the foregoing, the passage of this bill is earnestly sought. RODANTE D. MARCOLETA
