Escudero AN ACT INCREASING THE BENEFITS OF BARANGAY OFFICIALS, AMENDING FOR THE PURPOSE PARAGRAPH (A), SECTION 393, CHAPTER IV, TITLE I, BOOK III OF REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991 EXPLANATORY NOTE Barangays, as local government units, are administrative agencies that serve as front liners in government service whose availability is on a 24/7 basis. During the height of the pandemic in 2020 and 2021, barangay officials were tasked to implement the policies and directives of the national government for the delivery of the required services and assistance to the people from lockdown and quarantine operations, monitoring, testing to "ayuda" distribution, to name a few. Barangays are the closest to the people to effect immediate and timely government service which make their officials function beyond the normal service hours and days of the government. Thus, it is the objective of this bill to provide more benefits to barangay officials to recognize the performance of the duty imposed upon them not only by law but by the demands of their constituents and the nature of their office. Section 1. Paragraph (a), Section 393, Chapter IV, Title I, Book III of Republic
2 Act No. 7160 is hereby amended to read as follows: "Section 393. Benefits of Barangay Officials. - (a) Barangay officials, including barangay tanods and members of the lupong tagapamayapa, shall receive honoraria, allowances, and such other emoluments as may be authorized by law or barangay, municipal or city ordinance in accordance with the provisions of this Code, but in no case shall it be less than [One thousand pesos (P1,000.00)] TWENTY PERCENT (20%) HIGHER THAN THE MINIMUM WAGE RATE PREVAILING IN THE REGION per month for the punong barangay and [Six hundred pesos (P600.00)] THE MINIMUM WAGE RATE PREVAILING IN THE REGION per month for the sangguniang barangay members, barangay treasurer, and barangay secretary: Provided, however, That the annual appropriations for personal services shall be subject to the budgetary limitations prescribed under Title Five, Book Ill of this Code;
Sec. 2. Repealing Clause. - All laws, presidential decrees, executive orders,
rules, and regulations or parts thereof which are inconsistent with the provisions of this Act are hereby repealed or modified accordingly.
Sec. 3. Effectivity. - This Act shall take effect fifteen (15) days after its
