They promote innovation, inclusive growth, and safeguard basic rights by upholding sovereignty and territorial integrity, thus, contributing to socio-economic development and political stability. Meanwhile, infrastructure plays a critical role in sustaining and enhancing socio-economic development, further augmenting strategic activities related to national security and peace and order. In that regard, the Department of National Defense (DND) is responsible for guarding against external and internal threats to peace and national security, while the Department of Public Works and Highways (DPWH) serves as the engineering and construction arm of the State. To pursue the above interests, the DND and the DPWH launched a convergence program to strengthen and expand military facility readiness for national security and development called "Tatag ng Imprastraktura Para sa Kapayapaan at Seguridad (TIKAS)". TIKAS promotes the integration of plans and programs of both departments and facilitates efficient and coordinated efforts to identify, prioritize, and implement infrastructure projects to enhance the capability and readiness of the military. To maintain momentum and foster growth in military infrastructure development, continuity and consistency must be established, alongside strengthening
the program. Hence, the institutionalization of TIKAS must be pursued to make it an essential and more permanent government program, guaranteeing its sustainability and effectiveness. In view of the foregoing, the passage of this bill is earnestly sought. MARK A. VILLAR

VILLAR AN ACT INSTITUTIONALIZING THE PROGRAM ON STRENGTHENING AND EXPANDING MILITARY FACILITY READINESS FOR NATIONAL SECURITY, ALSO KNOWN AS TATAG NG IMPRASTRAKTURA PARA SA KAPAYAPAAN AT SEGURIDAD (TIKAS) Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section. 1. Short Title. - This Act shall be known as the "Tatag ng
Imprastraktura Para sa Kapayapaan at Seguridad (TIKAS) Act'".
Sec. 2. Declaration of Policy. - It is a declared policy of the State that the Armed
4 Forces of the Philippines (AFP) is the protector of the people and the State, with a 5 goal of securing the sovereignty of the State and the integrity of the national territory. 6 The State also recognizes that the maintenance of peace and order, the protection of 7 life, liberty, and property, and the promotion of the general welfare are essential for 8 the enjoyment by all the people of the blessings of democracy. Further, it is hereby declared a policy of the State to provide an efficient infrastructure system that promotes sustainable and inclusive economic growth and sound quality of life for all Filipinos. Hence, it is imperative that the capability of the 12 AFP be enhanced through providing them with efficient, strategic, and quality infrastructure in order for them to effectively pursue their mandate.
Sec. 3. Institutionalization of the TIKAS Program. - The Department of National
Defense (DND) and the Department of Public Works and Highways (DPWH) TIKAS Program, hereinafter referred to as the "Program", is hereby institutionalized for the 17 purpose of construction, rehabilitation, upgrading, and improvement of roads and
1 bridges, and other infrastructure projects jointly identified by both departments based 2 on technical criteria and priority areas in order to enhance the facility capability and readiness of the military in providing an environment of security conducive for national development and overall increase in the quality of life. The DND shall identify and prioritize infrastructure projects that will strengthen 6 and/or expand military facility readiness for national security and development. The DND and the DPWH shall develop the criteria for the identification and prioritization of infrastructure support to the priority areas and shall provide policy guidelines and supervision to the Program.
Sec. 4. Creation of the TIKAS Central Technical Working Group. - The TIKAS
Central Technical Working Group (CTWG) is hereby established to assist the DND and DPWH in their responsibilities under the Program. The CTWG shall be organized by the DND and the DPWH to be composed of personnel from the said departments. The TIKAS CTWG shall have the following duties and responsibilities: a) Draft, finalize, and follow the process flow for the evaluation of proposed infrastructure projects of the Program; b) Validate the draft priority list of infrastructure projects in support of the infrastructure development under the Program; c) Undertake an annual review and propose amendments or revisions, should there be any, to the project prioritization criteria and the process flow; d) Seek technical assistance of relevant experts and consultants; and e) Organize a Secretariat to the TIKAS CTWG who shall: i) Compile the necessary guidelines of the DND and the DPWH related to the Program; ii) Collect all the submitted proposals for the Program and their related documentary support; ili) Document meetings, activities, and outputs of the TIKAS CTWG; to the iv) Conduct regular monitoring and reporting Chairpersons of the TIKAS CTWG;
v) Prepare reports and proposals of the TIKAS CTWG; and vi) Conduct full-time research assistance to deliver the required network.
Sec. 5. Sub-National Technical Working Groups. - TIKAS Sub-National
Technical Working Groups (STWG) are also hereby established to be composed of one (1) personnel from the AFP-Unified Command (UC) and the component DPWH Regional Office (RO) covered by the UC area of operations. Each STWG shall be co-chaired by the UC Commander and the DPWH Regional Director concerned. The UC Commander shall determine his or her support staff, and the DPWH Regional Directors shall determine the division chiefs, technical staff, and administrative staff who will support them. The STWG shall have the following duties and responsibilities: a) Initiate, review, and validate infrastructure projects in their area commands for submission to the TIKAS CTWG; b) Respond to requests for information and validation for projects generated by the Central Offices of the DND and the DPWH by providing complete staff work in relation to the criteria and documentary requirements for approving the Program's projects; and c) Submit to the CTWG regular status reports of approved projects in their areas of responsibility.
Sec. 6. Duties and Responsibilities of the DND and the DPWH. -
a) In relation to this Act, the DND shall have the following duties and responsibilities: i) Provide the TIKAS CTWG with relevant data and materials on infrastructure relating to national defense and security, excluding classified information on defense and security, including technical planning and implementation, standards, and guidelines, for the purpose of having a more detailed and objective evaluation of project proposals and report preparation;
ii) Consolidate the inventory of pertinent data solely related to the construction of roads and other infrastructure, excluding classified information on defense and security; and iii) Provide the TIKAS CTWG copies of studies, proposals, guidelines, and other similar relevant materials on national security development and other developing security infrastructure. b) In relation to this Act, the DPWH shall have the following duties and responsibilities: i) Provide the TIKAS CTWG with relevant data and materials regarding the construction of roads and other infrastructure, excluding classified information on defense and security; ii) Provide TIKAS CTWG members from the DND with the applicable infrastructure planning systems, programs, budget, and databases; il) Provide the TIKAS CTWG copies of studies, proposals, guidelines, and other similar relevant materials on road infrastructure and other forms of infrastructure; and iv) Consolidate the inventory of DPWH-related data, as may be requested by the TIKAS CTWG. The DND and the DPWH shall allocate the necessary logistical and workforce requirements to achieve the purposes of the Program.
Sec. 7. Implementing Rules and Regulations. - The DND and the DPWH shall
promulgate the rules and regulations necessary to implement the provisions Act within ninety (90) days from its effectivity.
Sec. 8. Appropriations. - The amount necessary to carry out the provisions of
this Act shall be included in the respective budgets of the DND and the DPWH in the General Appropriations Act.
Sec. 9. Separability Clause. - If any provision of this Act is declared
unconstitutional, the remainder thereof not otherwise affected shall remain in full force and effect.
Sec. 10. Repealing Clause. - All laws, executive orders, rules and regulations,
2 or parts thereof inconsistent with any provision hereof are hereby repealed or modified accordingly
Sec. 11. Effectivity. - This Act shall take effect after fifteen (15) days from its
5 publication in the Official Gazette or in a newspaper of general circulation. Approved,
