Escudero AN ACT LOWERING THE COMPULSORY RETIREMENT AGE OF TEACHERS AND NON-TEACHING SCHOOL PERSONNEL OF THE DEPARTMENT OF EDUCATION FROM SIXTY-FIVE (65) TO SIXTY (60) YEARS OLD EXPLANATORY NOTE This bill seeks to lower the compulsory retirement age of personnel of the Department of Education (DepEd), including public school teachers, from sixty-five (65) to sixty (60) years old. The present system at the DepEd requires continuous skills enhancement and professional development of its personnel to ensure that the services rendered are sustainably modernized, restructured, and improved. This measure shall also open the doors of opportunities to young teachers and non-teaching aspirants for the jobs at the Education Department. If enacted into law, this proposed legislation will also benefit hundreds and thousands of teaching and non-teaching personnel of the DepEd who are eligible for retirement and who would want to spend the prime of their lives engaging in other productive activities other than their usual functions in the government. Section 1. Short Title. - This Act shall be known as the "New Department of
2 Education (DepEd) Retirement Age Act".
Sec. 2. Compulsory Retirement Age. - The compulsory retirement age for all
4 DepEd teachers and non-teaching school personnel shall be upon the attainment of 5 the age of sixty (60). An official or employee of the DepEd who has rendered less than 6 fifteen (15) years of government service may be allowed to continue holding office 7 until such time he or she reaches the compulsory retirement age of sixty-five (65) in 8 accordance with existing civil service and Government Service Insurance Service rules and regulations.
Sec. 3. Repealing Clause. - All laws, executive orders, rules and regulations,
and other issuances or parts thereof, which are contrary or inconsistent with this Act are hereby repealed or modified accordingly.
Sec. 4. Effectivity. - This Act shall take effect fifteen (15) days after its
publication in the Official Gazette or in at least two (2) newspapers of general circulation. Approved,
