The Land Transportation Office (LTO) reported that in 2024 alone, violations of the Anti-Drunk and Drugged Driving Act accounted for the vast majority of license revocations, 736 out of the 984 total driver's licenses canceled that year were due to driving under the influence? deter reckless and irresponsible behavior on the road, while the current scope of liability remains too limited to address those who knowingly enable or tolerate such dangerous conduct. Accordingly, this bill seeks to strengthen the Anti-Drunk and Drugged Driving Act by expanding liability beyond the intoxicated driver to include individuals who knowingly lend vehicles to impaired persons, as well as those who knowingly hire, request, or ride with drivers under the influence of alcohol or dangerous drugs. It likewise increases the corresponding fines and imposes stricter driver's license sanctions, including longer suspension periods and the immediate confiscation of licenses during the pendency of cases. To protect our motorists, pedestrians, and the general public, the swift passage of this bill is earnestly sought. ERWIN T. TULFO

SECTION 1. Section 5 of Republic Act No. 10586 or the "Anti-
Drunk and Drugged Driving Act of 2013" is hereby amended to read as follows: " SECTION 5. Punishable ActS. - It shall be unlawful for any person: to drive a motor vehicle while under the influence of alcohol, dangerous drugs and/or other similar substances. (a) TO DRIVE OR OPERATE A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS, AND/OR OTHER SIMILAR SUBSTANCES; (b) TO KNOWINGLY ALLOW, PERMIT, OR PROVIDE A MOTOR VEHICLE TO A PERSON WHO IS UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS, AND/OR ]
OTHER SIMILAR SUBSTANCES, WHEN SUCH PERSON THEREAFTER OPERATES THE SAME IN VIOLATION OF THIS ACT; (c) TO KNOWINGLY REQUEST, ENGAGE, OR RELY ON THE SERVICES OF A DRIVER WHO IS UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS, AND/OR OTHER SIMILAR SUBSTANCES, , AND TO RIDE OR BE TRANSPORTED IN A MOTOR VEHICLE OPERATED BY SUCH DRIVER, WHEN THE DRIVER OPERATES THE SAME IN VIOLATION OF THIS ACT; XXX
SEC. 2. Section 12 of Republic Act No. 10586 is hereby amended
to read as follows: " SECTION 12. Penalties. - A driver found to have been driving a motor vehicle while under the influence of alcohol, dangerous drugs and/or other similar substances, as provided for under ANY PERSON WHO HAVE BEEN FOUND TO BE IN VIOLATION OF Section 5 of this Act, shall be penalized as follows: (a)If the violation of Section 5 did not result in physical injuries or homicide, the penalty of three (3) months imprisonment, and a fine ranging from Twenty thousand pesos (Php 20,000) FIFTY THOUSAND PESOS (PHP 50,000.00) to Eighty thousand pesos (Php 80,000) ONE HUNDRED THOUSAND PESOS (PHP 100,000.00) shall be imposed; (b) If the violation of Section 5 resulted in physical injuries, the penalty provided in Article 263 of the Revised Penal Code or the penalty provided in the next preceding
: subparagraph, whichever is higher, and a fine ranging from One hundred thousand pesos (Php100,000.00) ONE HUNDRED FIFTY THOUSAND PESOS (PHP 150,000) to Two hundred thousand pesos (Php200,000.00) THREE HUNDRED THOUSAND PESOS (PHP 300,000) shall be imposed; (c) If the violation of Section 5 resulted in homicide, the penalty provided in Article 249 of the Revised Penal Code and a fine ranging from Three hundred thousand pesos (Php300,000.00) FIVE HUNDRED THOUSAND PESOS (PHP 500,000) to Five hundred thousand pesos (Php500,000.00) ONE MILLION PESOS (PHP 1,000,000) shall be imposed; and (d) The nonprofessional driver's license of any person found to have violated Section 5 of this Act shall also be confiscated and suspended for a period of twelve (12) TWENTY-FOUR (24) months for the first conviction and perpetually revoked for the second conviction. The professional driver's license of any person found to have violated Section 5 of this Act shall also be confiscated and perpetually revoked for the first conviction. The perpetual revocation of a driver's license shall disqualify the person from being granted any kind of driver's license thereafter. PROVIDED, THAT DURING THE PENDENCY OF THE CASE, THE DRIVER'S LICENSE SHALL BE CONFISCATED AND TURNED OVER TO THE LAND TRANSPORTATION OFFICE, AND SHALL BE RELEASED ONLY UPON THE FINAL DISPOSITION OF THE CASE. xXX "
SEC. 3. Implementing Rules and Regulations. - Within thirty
(30) days from the effectivity of this Act, the Land Transportation Office shall promulgate the necessary rules and regulations for the effective implementation of this Act.
SEC. 4. Separability Clause. - Should any provision or part of
this Act be declared unconstitutional or invalid, the other provisions and parts hereof, insofar as they are separable from the invalid ones, shall remain in full force and effect.
SEC. 5. Repealing Clause. - All laws, decrees, letters of
7 instruction, executive orders, rules and regulations and other issuances 8 or parts thereof inconsistent with this Act are hereby repealed or 9 modified accordingly.
SEC. 6. Effectivity. - This Act shall take effect fifteen (15) days
12 after its publication in the Official Gazette or in a newspaper of general circulation. Approved,
