No. 2135 Introduced by Senator Robinhood Padilla AN ACT UPGRADING THE CAMARINES NORTE PROVINCIAL HOSPITAL IN THE MUNICIPALITY OF DAET, PROVINCE OF CAMARINES NORTE INTO A TERTIARY LEVEL III GENERAL HOSPITAL TO BE KNOWN AS THE CAMARINES NORTE GENERAL HOSPITAL (CNGH), UNDER THE DIRECT CONTROL, SUPERVISION AND MANAGEMENT OF THE DEPARTMENT OF HEALTH (DOH), APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES EXPLANATORY NOTE

Section 11, Article XIII of the 1987 Constitution provides that "the State shall adopt

an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost. "To fulfill this constitutional mandate, the government must ensure the availability of health facilities, particularly hospitals, in all cities and provinces. These hospitals must also be provided with adequate resources to be able to deliver the needed medical care and services to the people. The Camarines Norte Provincial Hospital - the healthcare provider for over 600,000 Bicolanos in the province requires immediate attention. Established with an initial one hundred (100) bed capacity, the hospital increased its bed capacity to one hundred fifty

(150) beds in 1992. Since then, however, the population of the province has grown immensely and so has the number of patients that the hospital serves, causing hospital congestion and long waiting time before those in queues can be accommodated. In effect, many Bicolanos are being deprived of accessible, timely and quality health care services. This bill seeks to upgrade the Camarines Norte Provincial Hospital into a Tertiary Level III General Hospital under the Department of Health. By doing so, the hospital will be entitled to receive more resources from the national government, enabling it to fund the increase of its bed capacity, improve service capabilities, and deliver better quality health care services. This measure envisions bringing accessible, affordable and quality health care to the province of Camarines Norte and to as many Bicolanos that the hospital can serve. Section 1. The Camarines Norte Provincial Hospital in the Municipality of Daet,

2 Province of Camarines Norte is hereby upgraded into a Tertiary Level III General Hospital 3 to be known as the Camarines Norte General Hospital (CNGH) under the direct control, 4 supervision, and management of the Department of Health (DOH).

Sec. 2. The bed capacity of CNGH shall be increased from one hundred fifty (150)

6 to two hundred fifty (250). Subsequent increase in bed capacity shall be in accordance 7 with the hospital development plan which shall be prepared by the Chief of Hospital.

Sec. 3. The existing operating fund, service capability, health care services, and

2 facilities are also hereby upgraded to conform with and be commensurate to the increase 3 in bed capacity as provided in Section 2 hereof.

Sec. 4. The existing human resources for health of the CNGH, which includes

5 doctors, nurses, other healthcare practitioners, and support personnel, shall also be increased accordingly.

Sec. 5. The DOH, in coordination with the Department of Budget and Management

8 (DBM) and the Civil Service Commission (CSC), and in consultation with the management 9 of the hospital, shall determine the additional plantilla positions to be created as 10 workforce of CNGH.

Sec. 6. The Chief of the CNGH shall develop a hospital development plan to be

12 submitted to the DOH providing for the development goals of the hospital consistent with the increase in the bed capacity and service capability. Requests for the staffing, capital 14 outlay, and budget required for the effective and efficient operations of CNGH shall be 15 based on the hospital development plan.

Sec. 7. The Secretary of DOH shall include in its programs the implementation of

17 this Act and the funding of CNGH shall be included in the annual General Appropriations 18 Act.

Sec. 8. Within ninety (90) days from the effectivity of this Act, the Secretary of

20 DOH shall prepare the implementing rules and regulations upon consultation with the 21 Provincial Government of Camarines Norte, the Representative of the District, where the 22 hospital is located, and other stakeholders and shall be implemented consistent with the 23 hospital development plan.

Sec. 9. If any provisions or part of this Act is declared unconstitutional, the

25 remaining parts or provisions not affected shall remain in full force and effect.

Sec. 10. All laws, executive orders, issuances, rules and regulations, inconsistent

2 with this Act are hereby repealed or modified accordingly.

Sec. 11. This Act shall take effect fifteen (15) days after its publication in the

4 Official Gazette or in a newspaper of general circulation. Approved,
