Senate Office of the Gerretarp TWENTIETH CONGRESS OF THE ) REPUBLIC OF THE PHILIPPINES ) ) APR -6 A11 :17 First Regular Session SENATE RECEIVED BY: 2021 S. No. _ Introduced by Senator Robinhood Padilla AN ACT ASSERTING THE SOCIAL FUNCTION OF LAND BY MANDATING THE UTILIZATION OF IDLE AND UNDEVELOPED LANDS FOR FOOD PRODUCTION, ALIGNING NATIONAL AGENCIES AND DISTRICT REPRESENTATIVES FOR EMERGENCY FOOD SECURITY, AND PROVIDING TOTAL TAX EXEMPTIONS EXPLANATORY NOTE

Sec 6, Art. XII of the 1987 Constitution provides that the use of property bears

a social function, and all economic agents shall contribute to the common good. Furthermore, under the General Welfare Clause, the State possesses the Police Power to override private interests in the face of a "clear and present danger" to public health and food security. With the 2026 Middle East Crisis threatening to starve the supply chains of our cities, "idleness" is no longer a private choice but a public liability. This measure seeks to operationalize the social function of land by mandating the productive use of idle and undeveloped lands for food production during periods of food security emergencies. It also aligns national agencies, local government units, and district representatives to ensure coordinated and immediate action. By mobilizing idle lands, this proposed legislation aims to enhance food security, reduce dependence on imports, create local livelihoods, and strengthen national resilience during times of crisis.
