Villar AN ACT ESTABLISHING COMMUNITY FITNESS AND WELLNESS CENTER NATIONWIDE, AND APPROPRIATING FUNDS THEREFOR EXPLANATORY NOTE The 1987 Philippine Constitution mandates "the State to promote physical education and encourage sports programs, league competitions and amateur sports, including training for international competitions to foster self- discipline, teamwork and excellence for the development of a healthy and alert citizenry". The collective health of the people affects to a great extent the success of its overall socio-economic development. The state of health and mental fitness of every person are controlling factors on the ability to take advantage of education, technical capabilities and business entrepreneurship. One method of maintaining our physical and mental health condition is by involving our citizens in physical fitness activities and sports programs. This bill seeks the establishment of a community fitness and wellness center in every barangay nationwide. The said community fitness and wellness center will serve as venue for physical training and fitness, wellness program and sports activities of all the residents of the barangay. Villar AN ACT ESTABLISHING COMMUNITY FITNESS AND WELLNESS CENTER NATIONWIDE, AND APPROPRIATING FUNDS THEREFOR Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Declaration of Policy. - There shall be established, under the

2 supervision of the Municipal or City Health Officer, a community fitness and wellness center in every barangay nationwide. The community fitness and wellness center shall provide physical fitness programs, trainings and sports 5 activities. It shall likewise provide free seminars to would-be physical fitness 6 leaders and trainers in the barangay.

Sec. 2. Coverage. - The Municipal or City Mayor shall, upon the

recommendation of the local health board of the municipality or city where the 9 center is located, appoint a full-time fitness instructor who will manage the center.

Sec. 3. The fitness instructor shall receive a monthly compensation of

not less than Fifteen Thousand Pesos (P15,000.00) to be charged to the annual appropriations of the Municipal or City Health Office where the center is situated.

Sec. 4. The fitness instructor shall perform the following functions:

a) Formulate criteria for the selection of qualified individuals for training and accreditation as physical fitness instructors in the center; b) Introduce and implement varied physical fitness and sports competition within the barangay;

c) Conduct consultation with the residents of the barangay in identifying any physical fitness activity and sports program that shall be implemented by the center; d) Oversee and ensure the continuous and effective implementation of the physical fitness activities and sports program undertaken by the center; e) Disseminate proper information on the policy and objective of their physical fitness and sports activities to encourage the active participation of all the residents of the barangay; and f) Perform such other functions as the Municipal or City Health Officer may delegate or assign.

Sec. 5. Appropriation. -The amount necessary for the initial

12 implementation of this Act shall be charged to the appropriations of the Department of the Interior and Local Government. Thereafter, such sum as may be necessary for the continued operation and maintenance of the community fitness centers shall be included in the annual budget of the city or municipality where the community fitness center is located.

Sec. 6. Separability Clause. - If any provision of this Act is held invalid

or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect.

Sec. 7. Repealing Clause. - All laws, ordinances, rules, regulations,

issuances, or parts thereof which are inconsistent with this Act are hereby repealed or modified accordingly.

Sec. 8. Effectivity. - This Act shall take effect fifteen (15) days after its

publication in the Official Gazette or in a newspaper of general circulation. Approved,
