Section 39 of Republic Act No. 6975, as amended, currently sets the compulsory
retirement age for officers and non-officers of the Philippine National Police (PNP) at fifty-six (56) years old. This statutory provision has remained unchanged despite the evolving demands of police service as well as the need for continuity in leadership and operational expertise. Just last year, a broader measure seeking to introduce structural reforms in the PNP was submitted to the Office of the President. The proposal expressed in this bill formed part of the set of reforms that that earlier measure forwarded. While that said measure was vetoed, this current proposal regarding the retirement age of officers and non-officers of the PNP was not among the vetoed provisions. This signals no fundamental objection to the policy goal of adjusting the PNP retirement age. What it signals, instead, is the need for it to be pursued through a separate and focused legislation. This bill responds to that need. By increasing the compulsory retirement age from 56 to 57, the measure harmonizes the retirement policy for the PNP with that of the Armed Forces of the Philippines (AFP), thereby recognizing the equal importance
of our internal and external security forces. It ensures that there is no loss of institutional knowledge, operational leadership, and specialized skills of senior officers. At the same time, those with less than one year remaining in service are also granted the option to retire under the previous age limit. The proposed adjustment is modest, but the implications are far-reaching. The PNP in particular and the community in general both stand to gain from greater flexibility in human resource planning, a more efficient use of government resources, and the continued service and wisdom from seasoned personnel. Section 1. Section 39 of R. A. No. 6975, as amended by R. A. 11200, is hereby
2 amended to read as follows: "SEC. 39. Compulsory Retirement. - Compulsory retirement, for officer and non-officer, shall be upon the attainment of age [fifty six (56)] FIFTY- SEVEN (57): Provided, That, [in case of any officer with the rank of Police Brigadier General, Police Major General or Police Lieutenant General, the Commission may allow his retention in the service for an unextendible period of one (1) year.] UNIFORMED PERSONNEL WHO HAVE LESS THAN ONE (1) YEAR IN THE SERVICE UPON THE EFFECTIVITY OF THIS ACT SHALL HAVE THE OPTION TO REHRE AT THE AGE OF FIFTY-SIX (56)."
Sec. 2. Repealing Clause. - All other laws, decrees, orders, rules and
regulations or portions thereof that are inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

Sec. 3. Effectivity. - This Act shall take effect fifteen (15) days after its complete
publication in the Official Gazette or in a newspaper of general circulation. Approved,
