Section 9 of Article II of the 1987 Philippine Constitution provides that "The

State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all." The barangay, as the primary unit of our government, is at the forefront of delivering essential public services that directly impact the lives of our citizens. This proposed measure seeks to create a barangay to be known as Barangay Bukal in the Municipality of Nabunturan, Province of Davao De Oro to better serve its constituents. Located in the first-class Municipality of Nabunturan, Barangay Bukal is home to 4,461 residents according to the 2020 Census of Population and Housing. Despite its long-standing existence and functioning local government, Barangay Bukal has been unable to receive its share of the National Tax Allotment (NTA) because its creation was by virtue of a provincial ordinance, and not by law. This measure will enhance the barangay's capacity to deliver efficient basic services, maintain public infrastructure, and implement development programs for its people. By formally recognizing Barangay Bukal through a law, we empower it to access the resources it is entitled to, thereby enabling it to fulfill its mandate under the Local Government Code of 1991, as amended, and improve the quality of life for its residents. MARCOS AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY BUKAL IN THE MUNICIPALITY OF NABUNTURAN, PROVINCE OF DAVAO DE ORO Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Creation of Barangay Bukal. - There is hereby created a barangay

to be known as Barangay Bukal in the Municipality of Nabunturan, Province of Davao de Oro. The territorial boundaries of Barangay Bukal are hereby described as follows: A parcel of land, situated in the Municipality of Nabunturan, Province of Davao; 6 Bounded on the North, point 2-3-4-5-6, by Mainit National Park and points 1-2 and 6- 7 7, by barangay Mainit; on the east, points 7-8, by the Municipality of New Bataan; on the South, points 8-9, by the Municipality of Maco; and on the West, points 9-1, by the Municipality of Mawab, beginning at a point marked "1" being located at a point 125 10 deg. 59, 45" East 7 deg. 29" North; thence N deg. E, 1,900 m. to point 2; S deg. W, m. to point 3; deg. E, 2,160 m. to point 4; N deg. E, 2,950 m. to point 5; N deg. W, 1,940 m. to point 6; m. to point 7; deg. E, 3,250 deg. E, 5,800 m. to point 8; N m. to point 9; deg. W, 9,920 N deg. W, 3,300 m. to point beginning;

Containing an area of approximately THREE THOUSAND AND FIFTY-FIVE 2 (3,055) HEACTARES. All points referred to are indicated on the map attached.

SEC. 2. Conduct and Supervision of Plebiscite. - The plebiscite conducted and

supervised by the Commission on Elections (COMELEC) pursuant to Provincial Ordinance No. 03 series of 1993, enacted and approved by the Sangguniang • Panlalawigan of Davao on December 15, 1993, which ratified the creation of Barangay Bukal as proclaimed by the Plebiscite Board of Canvassers, shall serve as a substantial 8 compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, • otherwise known as the Local Government Code of 1991, as amended.

SEC. 3. Barangay Officials. - The incumbent elected barangay officials of

Barangay Bukal in the Municipality of Nabunturan, Province of Davao de Oro shall continue to hold office until such time that their successors have been duly elected 14 and qualified.

SEC. 4. Public Infrastructure and Facilities. - All existing public infrastructure

and facilities for public use existing therein at the time of the approval of this Act are hereby transferred without cost of compensation to, and shall be administered by, the new Barangay Bukal.

SEC. 5. National Tax Allotment (NTA). - Barangay Bukal in the Municipality of

Nabunturan, province of Davao de Oro, shall therefor be entitled to National Tax Allotment (NTA) shares pursuant to existing laws, rules, and regulations.

SEC. 6. Effectivity. - This Act shall take effect after fifteen (15) days following

its publication in the Official Gazette or in a newspaper of general circulation. Approved,
