No. 1374 Introduced by Senator Robinhood Padilla AN ACT RECOGNIZING THE CONTRIBUTIONS OF INDIGENOUS PEOPLES TO NATION-BUILDING BY GRANTING THEM APPROPRIATE CIVIL SERVICE ELIGIBILITY, AFTER HAVING SERVED AS INDIGENOUS PEOPLES MANDATORY REPRESENTATIVES (IPMR) FOR AT LEAST THREE (3) YEARS, AND FOR OTHER PURPOSES EXPLANATORY NOTE In recognition of indigenous peoples' (ICCS/IPs) distinct rights, Republic Act No. 8371 or the Indigenous Peoples Rights Act (IPRA) Law institutionalized the inclusion of IPs in local legislative councils or policy-making bodies in all levels of decision making in matters which may affect their rights, lives, and destinies. As such, an IP Mandatory Representative (IPMR), duly selected in accordance with the National Commission on Indigenous Peoples (NCIP) Revised National Guidelines on the matter, shall be made part of a local government unit where there exists an ancestral domain or ancestral land (AD/AL), or in the absence of AL/AD through the rule on thresholds, or upon the initiative of the IPs therein. IPMRs are entrusted with the responsibility of ensuring that the rights, welfare, and perspectives of IPs are included in governance and local legislation. Such a role demands leadership, dedication, and an understanding of national and customary laws, as well as government processes. This measure grants IPMRs with Career Service Sub-Professional Eligibility after having served for at least three (3 years) in their post. It affirms the commitment of

the State to inclusivity in governance by duly recognizing the valuable service of IPMRs, while also providing a pathway for IPs to sustain their involvement in public affairs and to serve as potential civil servants. Section 1. Short Title. - This Act shall be known as the "Katutubo Para sa

2 Gobyerno Act".

Sec. 2. Objective. - This Act seeks to enable the participation of Indigenous

Peoples (IPs) in nation-building by enhancing their access to government positions, and to provide opportunities for IP Mandatory Representatives (IPMRs) to continue 6 serving the government through the grant of civil service eligibility in order to 7 institutionalize an inclusive system of governance that duly recognizes IPs' 8 contributions to the State.

Sec. 3. Conferment of Eligibility. - IPs who have completed at least three (3)

10 years of continuous and satisfactory service as IPMR in the local legislative councils and policy-making bodies shall be granted an eligibility equivalent to Career Service Sub-Professional Eligibility: Provided, That such IPMR shall still be evaluated in accordance with the education, training, or work experience prerequisites for the civil 14 service position being applied for: Provided, further, That the eligibility granted under 15 this section shall be considered appropriate for second and first level positions in the

career service respectively, except those which require qualifications in skills or trade test and/or requiring board examinations and other special eligibilities provided under special laws.

Sec. 4. Implementing Rules and Regulations. - Within ninety (90) days from

5 the effectivity of this Act, the Civil Service Commission (CSC), in consultation with the National Commission on Indigenous Peoples (NCIP) shall issue the Implementing 7 Rules and Regulations for the immediate implementation of this Act.

Sec. 5. Separability Clause. - If any provision or part hereof is held invalid or

unconstitutional, the remaining provisions not affected thereby shall remain valid and subsisting.

Sec. 6. Repealing Clause. - Any law, presidential decree or issuance, executive

order, letter of instruction, administrative order, rule or regulation contrary to or inconsistent with the provisions of this Act is hereby repealed, modified or amended accordingly.

Sec. 7. Effectivity. - This Act shall take effect fifteen (15) days after its

publication in the Official Gazette or in any two (2) newspapers of general circulation in the Philippines. Approved,
