MARCOS AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY LIBUTON IN THE MUNICIPALITY OF SAN ISIDRO, PROVINCE OF DAVAO DEL NORTE EXPLANATORY NOTE
Section 9 of Article II of the 1987 Philippine Constitution provides that "the
State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all." Republic Act No. 7160, or the Local Government Code of 1991, as amended, establishes the barangay as the primary planning and implementing unit of government policies, plans, programs, projects, and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicably settled. For a barangay to effectively fulfill these roles, its size and population must be proportional to allow for efficient service delivery and adequate representation. Barangay Libuton is situated in the third-class Municipality of San Isidro, Province of Davao del Norte. According to the 2020 Census, Barangay Libuton has a population of 971 residents representing 3.57% of the total population of San Isidro. Its population fell from 1,212 in 1995 to 971 in 2020, a decrease of 241 people over the course of 25 years. The latest census figures in 2020 denote a positive growth rate of 0.17%, or an increase of 8 people, from the previous population of 963 in 2015. For decades, Barangay Libuton has been precluded from receiving its share of the National Tax Allotment (NTA). This is due to the fact that its creation was not enacted through a national law, a requirement for it to be officially included in the NTA allocation. This lack of funding has severely hampered the barangay's ability to deliver adequate social services and implement development projects for its residents.
Hence, this bill seeks to establish Barangay Libuton in the Municipality of San Isidro, Province of Davao del Norte, as a government unit by virtue of a law, pursuant to Section 385 of the Local Government Code of 1991, as amended, and aims to enable it to receive its NTA shares and thereby ensure its economic and financial viability. MARCOS AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY LIBUTON IN THE MUNICIPALITY OF SAN ISIDRO, PROVINCE OF DAVAO DEL NORTE Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Creation of Barangay Libuton. - There is hereby created a
barangay to be known as Barangay Libuton in the Municipality of San Isidro, Province 3 of Davao del Norte.
SEC. 2. Conduct and Supervision of Plebiscite. - The plebiscite conducted and
supervised by the Commission on Elections (COMELEC), pursuant to Provincial 7 Ordinance No. 4, enacted and approved by the Sangguniang Panlalawigan of Davao on 28 August 1991, that ratified the creation of Barangay Libuton as proclaimed by • the Plebiscite Board of Canvassers on 30 August 1992, shall serve as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, as amended.
SEC. 3. Barangay Officials. - The incumbent elected barangay officials of
Barangay Libuton in the Municipality of San Isidro, Province of Davao del Norte shall continue to hold office until such time that their successors have been duly elected and qualified.
SEC. 4. Public Infrastructure and Facilities. - All existing public infrastructure
and facilities for public use existing therein at the time of the approval of this Act shall
be transferred without cost or compensation to, and shall be administered by, the new Barangay Libuton.
SEC. 5. National Tax Allotment (NTA) Share. - Barangay Libuton shall therefor
be entitled to National Tax Allotment (NTA) shares pursuant to existing laws, rules, and regulations.
SEC. 6. Effectivity. - This Act shall take effect after fifteen (15) days following
its publication in the Official Gazette or in a newspaper of general circulation. Approved,
