Section 9, Article II of the 1987 Philippine Constitution provides that, " The State

shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all." Republic Act No. 7160, or the Local Government Code of 1991, as amended, provides that the barangay serves as the primary planning and implementing unit of government policies, plans, programs, projects, and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicably settled. To serve the aforementioned purposes effectively, a barangay's population and geographical size must allow for efficient service delivery and adequate representation. The Municipality of Suyo is a 4th class municipality in the province of Ilocos Sur. However, Barangay Suyo Proper is exceptionally large in both population and land area, making it difficult for the local government to provide timely and effective services to all its residents. According to the 2020 Census of Population and Housing conducted by the Philippine Statistics Authority (PSA), the Municipality of Suyo has a population of 10,766 across its eight (8) barangays. The creation of a new barangay will help decentralize governance and bring government services closer to the people in the remote sitios. This bill will ensure that

residents of the newly formed Barangay Kinapian, composed of the Sitios of Kimbuaya, Longboy, Bulala, Kinapian, Indadangan, Kumanibe, and Macaag, can more easily access essential government resources and participate in local planning and development. SECTION 1. Creation of Barangay Kinapian. - The sitios of Kimbuaya, Longboy,

Bulala, Kinapian, Indadangan, Kumanibe and Macaag in Barangay Suyo, Municipality of Suyo, Province of Ilocos Sur are hereby separated from Barangay Suyo Proper in the Municipality of Suyo, Province of Ilocos Sur to create a distinct and independent barangay to be known as Barangay Kinapian.

Sec. 2. Territorial Boundaries. - The territory of Barangay Kinapian is hereby

Sec. 3. Conduct and Supervision of Plebiscite. - Pursuant to Section 10 Republic

Act No. 7160, otherwise known as the Local Government Code of 1991, as amended, the creation of Barangay Kinapian shall be subject to the approval by a majority of qualified voters of Barangay Suyo through the votes cast in a plebiscite to be conducted and supervised by the Commission on Elections (COMELEC) within ninety (90) days from the effectivity of this Act. The expenses for the plebiscite shall be borne by the Municipality of Suyo, Province of Ilocos Sur.

Sec. 4. Barangay Officials. - The first set of barangay officials of Barangay

Kinapian shall be appointed by the Municipal Mayor of Suyo, and shall hold office until their successors have been duly elected and qualified.

Sec. 5. Public Infrasturcture and Facilities. - All public property, infrastructure,

and facilities existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new Barangay Kinapian.

Sec. 6. National Tax Allotment (NTA) Shares. - Barangay Kinapian shall be

entitled to its share in the NTA in accordance with existing laws, rules, and regulations.

Sec. 7. Effectivity. - This Act shall take effect after fifteen (15) days following its

publication in the Official Gazette or in a newspaper of general circulation. Approved,
