AND CO-PILAR AN ACT ALIGNING THE CHARTER OF THE PALOMPON POLYTECHNIC STATE UNIVERSITY WITH REPUBLIC ACT NO. 8292, OTHERWISE KNOWN AS THE "HIGHER EDUCATION MODERNIZATION ACT OF 1997," AMENDING FOR THE PURPOSE SECTIONS 6 AND 9 OF REPUBLIC ACT NO. 10599, ENTITLED "AN ACT CONVERTING THE PALOMPON INSTITUTE OF TECHNOLOGY IN THE MUNICIPALITY OF PALOMPON, PROVINCE OF LEYTE INTO A STATE UNIVERSITY TO BE KNOWN AS THE PALOMPON POLYTECHNIC STATE UNIVERSITY, INTEGRATING THEREWITH THE MARCELINO R. VELOSO NATIONAL POLYTECHNIC COLLEGE IN THE MUNICIPALITY OF TABANGO, PROVINCE OF LEYTE AND APPROPRIATING FUNDS THEREFOR," AS AMENDED BY REPUBLIC ACT NO. 11309 Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Section 6 of Republic Act No. 10599, entitled "An Act Converting the

Palompon Institute of Technology in the Municipality of Palompon, Province of Leyte into a State University to be Known as the Palompon Polytechnic State University, Integrating Therewith the Marcelino R. Veloso National Polytechnic College in the Municipality of Tabango, Province of Leyte and Appropriating Funds Therefor," is hereby amended to read as follows: "SEC. 6. [The Governing Board) THE BOARD OF REGENTS. - The governing body of the University shall be the Board of Regents, hereinafter referred to as the Board[, which shall be composed of the following;]. THE CHAIRPERSON OF THE BOARD SHALL BE THE CHAIRPERSON OF THE COMMISSION ON HIGHER EDUCATION (CHED) AND THE PRESIDENT OF THE UNIVERSITY SHALL SERVE AS VICE CHAIRPERSON. THE BOARD SHALL ADDITIONALLY CONSIST OF THE FOLLOWING MEMBERS:

[(a) The Chairperson of the Commission on Higher Education (CHED), Chairperson; (b) The President of the University, Vice Chairperson;] [(c) The] (A) Chairperson of the Committee on [Education, Arts and Culture] HIGHER, TECHNICAL AND VOCATIONAL EDUCATION of the Senatel, member]; [(d) The] (B) Chairperson of the Committee on Higher and Technical Education of the House of Representatives, member]; [(e) The] (C) Regional Director of the [National Economic and Development Authority (NEDA)] DEPARTMENT OF ECONOMY, PLANNING AND DEVELOPMENTI, member]; [(1) The] (D) Regional Director of the Department of Science and Technology|(DOST), member]; [(g) The] (E) President of the federation of faculty associations of the UniversityL, member]; [(h) The] (F) President of the federation of student councils of the Universityl, member]; ((i) Thel (G) President of the federation of alumni associations of the UniversityL, member]; (H) PRESIDENT OF THE NON-ACADEMIC AND NONTEACHING PERSONNEL OF THE UNIVERSITY; and [G)] (I) Two (2) prominent citizens from the private sector who have distinguished themselves in their professionS or [the] fields of specialization[of the University, members] The Board shall appoint the [two (2) prominent citizens] SAID MEMBERS from (among] a list of at least five (S) qualitied persons [in| FKOM the Province of Leyte, as recommended by the) A search committee constituted by the University President, in consultation with the Chairperson of the CHED and [the] other members of the Board, based on the [normal standards and] qualifications STANDARDS SET BY THE BOARD for the position. THEY SHALL SERVE FOR A TERM OF TWO (2) YEARS FROM THE DATE OF APPOINTMENT. The termS of office of the RESPECTIVE PresidentS of the [United Filipino Seafarers, the President of the] federation of faculty associations, [the President of the] federation of student councils, [and the President of the] federation of alumni associations, AND THE NON-ACADEMIC AND NONTEACHING PERSONNEL shall be coterminous with their [respective]

terms of office, as [set forth in] PROVIDED UNDER their respective constitutions and bylaws. [The two (2) prominent citizens shall serve for a term of two (2) years from the date of appointment.] IN CASE OF VACANCY AMONG APPOINTIVE POSITIONS IN THE BOARD, THE VACANCY SHALL BE FILLED BY THE BOARD FOLLOWING GUIDELINES SET BY IT AND THE APPOINTEE SHALL HOLD OFFICE ONLY FOR THE UNEXPIRED PORTION OF THE TERM."

SEC. 2. Section 9 of Republic Act No. 10599, as amended by Republic Act No. 11309

is hereby further amended to read as follows: "SEC. 9. The University President. - The University shall be headed by a Presidentl, who shall render full-time service and] who shall be appointed by the Board, subject to [the] ITS guidelines, qualifications, and standards [set by the Board], AND BASED ON THE [upon] recommendation of a [duly constituted] search committee[.] DULY CONSTITUTED FOR THE PURPOSE OF SELECTING THE PRESIDENT. The University President shall [have] RENDER FULL-TIME SERVICE FOR a term of four (4) years, and [shall be eligible for reappointment] MAY BE REAPPOINTED [for] TO another term: Provided, That in order to effect a smooth transition to a state university, the incumbent President of the Palompon Institute of Technology, if qualified, shall serve as the [interim] FIRST President of the University [However, within three (3) months from the effectivity of this Act, a new President shall be appointed by the Board.] WHO SHALL NOT BE ELIGIBLE FOR REAPPOINTMENT. Within two (2) months before the expiration of the term of office of the [interim] INCUMBENT President of the University, the Board shall constitute the Search Committee for the Presidency (SCP). In case of vacancy in the Office of the President by reason of death, compulsory retirement, resignation, removal for cause or incapacity of the President to perform the functions of the office, the Board shall designate an Officer-in-Charge of the University, [within six (6) months from the date of vacancy,] pending the appointment of a new President[. The successor or the Officer-in-Charge]: PROVIDED, THAT THE OIC shall serve only DURING the unexpired portion of the term. The powers and duties of the President of the University, in addition to those specifically provided in this Act, shall be those usually pertaining to the Office of the President of similar universities, and those delegated by the Board. The salary of the President of the University shall be in accordance with [the Revised Compensation and Position Classification System and shall be comparable to that being received by the Presidents of similar educational institutions.] REPUBLIC ACT NO. 11466, OTHERWISE KNOWN AS THE "SALARY STANDARDIZATION LAW OF 2019," AND SUCH OTHER

LAWS AMENDATORY THERETO, WHICH MAY HEREINAFTER BE ENACTED, AND ON THE JOINT CIRCULAR ON LEVELING INSTRUMENTS FOR STATE UNIVERSITIES AND COLLEGES AND GUIDELINES OF THE CHED AND THE DEPARTMENT OF BUDGET AND MANAGEMENT. The President of the University shall be assisted by the FOLLOWING OFFICIALS: Vice President for Academic Affairs, Vice President for Administration, PLANNING, AND FINANCE; AND Vice President for Research, DEVELOPMENT, AND Extension [and External Affairs, who]. THEY shall be appointed by the Board upon the recommendation of the President OF THE UNIVERSITY.

SEC. 3. The provisions of Republic Act No. 8292 shall form part of this Act.

SEC. 5. All other laws, presidential decrees, executive orders, and rules and regulations

contrary to or inconsistent with the provisions of this Act are amended, repealed, or modified accordingly.

SEC. 6. This Act shall take effect fifteen (15) days after its complete publication in the

Official Gazette or in a newspaper of general circulation. Approved,
